So, if the 50-year post-death rule is used, the question is whether that time frame applies to the photographer or the subject. If the photographer, then the photo would have to be more than 50 years post the death of the photographer. Need to find out when the photographer died. Seems Oz's copyright rule is 70 pma; 50 pma (death before 1955); photographs 50 pd. So, if the 50-year post-death rule is used, the question is whether that time frame applies to the photographer or the subject. If the photographer, then the photo would have to be more than 50 years post the death of the photographer. If it applies to the subject, then the image is out of copyright. If the photographer died before 1962, then the photo is likely out of copyright. If the photographer died after 1962 then the copyright doesn't expire until death of the photographer + 50 years, and it's use would fall under fair-use only until then.
